JUSTICE PARTHA SARTHY ORAL ORDER 11-11-2020 Heard learned counsel for the petitioner and learned APP for the State, through video conferencing. The petitioner who is in custody since 27.2.2019 has renewed his prayer for regular bail in connection with Mahila P.S. Case No. 5 of 2019 registered under sections 376, 323 and 506 of the Indian penal Code and section 4 of the POCSO Act. At the outset it is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected by order dated 18.9.2019 (Annexure-1) passed in Cr. Misc. No. 38175 of 2019, giving liberty to the petitioner to renew his prayer for bail after completing one year in custody. It is further submitted that the petitioner is in custody since 27.2.2019 and has no criminal antecedent.

The application for bail is opposed by learned APP for

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the liberty granted to the petitioner in the earlier order of rejection dated 18.9.2020 (Annexure-1) together with the petitioner being in custody since 27.2.2019, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Mahila P.S. Case No. 5 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) only with two sureties of the like amount each to the satisfaction of the learned 1st Additional District and Sessions Judge-cum-Special Judge (POCSO), Aurangabad.
