The petitioners apprehend their arrest in Birupur P.S. Case No. 22 of 2020, registered for the offences punishable under Sections 307, 379, 341, 323, 324, 504, 506, 147, 149 of the Indian Penal Code.
As per the FIR, Ravindra @ Ravindra Jha petitioner no. 2 assaulted the son of informant by bricks on his face whereas, Dipu Jha @ Dipu Kumar snatched his golden chain. It is submitted on behalf of petitioners that allegation of assault is against petitioner no. 2. So far as petitioner no. 1 is concerned, it is alleged that petitioner no. 1 snatched golden chain. Injury report also corroborates the prosecution version
Patna High Court CR. MISC. No.29195 of 2020(3) dt.06-01-2021 2/2 and the doctor has found incised wound and lacerated wound on different parts of the body of informant's son caused by sharp cutting weapons.
So far as the case of Ravindra Jha @ Ravindra petitioner no. 2 is concerned, I am not inclined to enlarge him on anticipatory bail. Accordingly, the same is rejected. Considering the fact that there is no allegation of assault, petitioner no. 1 above-named, in the event of his arrest/surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Lakhisarai in connection with Birupur P.S. Case No. 22 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
