JUSTICE SUDHIR SINGH ORAL ORDER 12-07-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending her arrest in a case instituted under Sections 341, 323, 324 and 504/34 of the Indian Penal Code and Section 3 (i) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Allegation against the petitioner is to have assaulted informant with fists and legs and also assaulted him with sharp weapon causing injury.

It is submitted on behalf of the petitioner that he has got no criminal antecedent. He has falsely been implicated in the present case. It is a case and counter case between the parties. All the offences are bailable except for the offence under SC and ST Act. Since the alleged occurrence has not taken place in public view, hence, no offence under SC and ST Act is made out. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his/her arrest or surrender in the court below within a period of six weeks, be released on bail

Patna High Court Cr.Misc. No.26685 of 2016 (3) dt.12-07-2016 2/2 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Munger, in connection with S.C./S.T. P.S. Case no. 8 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
