ANJANA MISHRA ORAL ORDER 26-10-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is Dakpal functioning in the office of Superintendent of Post Offices, Rohtas Division, Sasaram, apprehends his arrest in connection with a case registered for the offences punishable under Sections 409 of the Indian Penal Code. Learned counsel for the petitioner submits that though, it is alleged that a total amount of Rs. 6,96,720/- remains due from him, being the transaction amount of MMTS (Mobile Moneyorder Transfer System), the petitioner submits that the entire amount has already been submitted in the office as on date. It is further submitted that even the MMTS have also been returned back to the concerned post-office. In support of such contentions, the petitioner has annexed Annexures-2 and 3 which are receipts from

Patna High Court Cr.Misc. No.27166 of 2016 (6) dt.26-10-2016 P2/2 the concerned post-office.

Having considered learned counsel for the petitioner and after hearing learned counsel for the State, let the petitioner abovenamed, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Bikramganj, Rohtas, in connection with Karakat P.S. Case No. 115/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
