JUSTICE VIKASH JAIN ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 23-02-2015 The petitioner is an Upmukhiya of Balugram Panchayat. He filed this writ petition by way of public interest with a prayer to direct the respondents to grant flood relief to 662 families, aggregating to Rs.47,58,000.00. He contends that the village was affected in the year 2008 with floods and, though the Government is under obligation to extend flood relief to the affected persons, these persons

On behalf of the respondents, a detailed counter affidavit, together with supportive documents is filed. The respondents state that in the floods that occurred in 2008, as many as 2141 families were found to be affected and all of them were extended the benefit. It is also stated that the former Chief Minister Shri Jagannath Mishra submitted a list of 464 eligible persons and thereafter, on verification of the same, relief was extended to 351 persons. The respondents submitted that the list submitted by the petitioner has been found to be fictitious and no decision need be taken thereon. The list of the persons furnished, to be extended flood relief runs in more than 500 pages.

Heard Shri Kumar Ravi Shankar, learned counsel for the petitioner, and Shri Ajay Behari Sinha and Mr. Suryakant Kumar, learned counsel for the respondents. From a perusal of the record, we find that the petitioner is involved in a fanciful litigation. Though the floods occurred in the year 2008, and relief was extended after due verification, he came forward with some fanciful claims. We would have certainly appreciated if the affected persons were before this Court. When none of them are

The writ application is dismissed as being devoid of any merits.

Interlocutory application, if any, stands disposed of.

There shall be no order as to costs.
