1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 318(2), 338, 336(3), 340(2), 352, 351(2), 61(2) of the BNS.
3. The informant alleges that the land which has been purchased by petitioner no.1 Md. Naimuddin belongs to the maternal grandfather of the informant as such informant has share in the land but then Md. Naimuddin purchased the land from the sister and brother-in-law of his maternal grandfather and thereafter sold the land to the petitioner no.1. It is further alleged that the said sale was made by forging the documents and the sale deed does not include the correct Khesra number of

4. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent.

Learned counsel for the petitioners submits that petitioners have been falsely implicated in the present case, it is next submitted that the petitioner no.1 had purchased the land and petitioner no.2 is husband of petitioner no.1, it is further submitted that Md. Niammuddin had purchased the land from sister of maternal grandfather of the informant and from Md. Niamuddin petitioner no.1 purchased the land. It is also submitted no doubt there is some mistake in the sale deed with respect to the description of the said land but then petitioners have approached Md. Niamuddin for getting it rectified. It is also submitted that informant, instead of filing a case before the Court of competent civil jurisdiction for getting the sale deed cancelled, instituted the instant criminal case in order to coerce the petitioners into submission.
6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
7. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court
Patna High Court CR. MISC. No.28531 of 2025(2) dt.07-05-2025 3/3 within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Jokihat P.S. Case No. 236 of 2024 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
