The Association filed the writ petition with a prayer to direct the Respondents to revise the pension in terms of revised pay scales of 2006 determined by the 6th Pay Commission. The

Patna High Court CWJC No.16774 of 2013 dt.23-02-2015 petitioner contends that though the retired employees were entitled for revision of their pension on the basis of 6th Pay Revision Commission, such revision has not taken place. The Respondents filed counter affidavit stating that the Finance Department of the State Government passed a resolution No.820 dated 23.09.2009 revising the pension and the same has been circulated to all the concerned authorities and there is no cause of action for the petitioner Association.

Heard Sri Jyoti Ranjan Jha, learned Counsel for the petitioner and Sri Avanindra Kumar Jha, Assistant Counsel to Additional Advocate General-13.

The petitioner seeks a general direction to the Respondents for revision of pension in the light of 6th Pay Commission. The Respondents on the other hand submits that the claim of the petitioner is vague and general. This Court would have been in a position to examine the matter, if any specific instance of the plea of any pensioner for enhancement of pension is not considered and the Government. Letters have been addressed to the Association by the Government to the effect that the benefit of pension has already been extended to the pensioners. An attempt is also made to find fault with the Banks in this regard. Unless specific orders in respect of each pensioner are passed, there is hardly anything that exists, for the Banks to act upon.

Patna High Court CWJC No.16774 of 2013 dt.23-02-2015 Hence we dispose of this writ petition with a direction that in case there is any grievance, the individual pensioners may approach the concerned authority or this Court for redressal of their grievance.

The writ petition is disposed of.

Interlocutory Applications, if any, stands disposed of. There shall be no order as to costs.
