Petitioner apprehends his arrest in Mehsi PS Case No. 40 of 2018, registered under Sections 30 and 38 of the Excise Act. The allegation in brief is that there is recovery of three bottles of foreign liquor from the vehicle of the petitioner. Submission is that the vehicle was taken away by the driver who was apprehended with his two friends, the petitioner was not in the vehicle and he has clean antecedent.

Having considered the said facts and circumstances, the petitioner Lal Babu Prasad is directed to be released on bail in the event of his arrest or surrender within a period of four weeks from today on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge IV -cum- Special Judge (Excise), Motihari, East Champaran in connection with Mehsi PS Case No. 40 of 2018 subject to the conditions as laid down under Section 438(2) Cr.P.C.
