JUSTICE SANJAY PRIYA ORAL ORDER 22-11-2017 Heard learned counsel for the petitioners and learned counsel for the State.

This application has been filed for modification of the order dated 21.03.2017 passed in Cr. Misc. 7879 of 2017. It has been submitted that petitioner was granted anticipatory bail by the aforesaid order but he could not surrender in the court below within stipulated time as they had gone to Delhi to earn their livelihood and did not get leave to come and surrender before the court below, and, hence he prays for extension of time of further six weeks to surrender before the court below.

In such circumstances, this modification application is allowed to the extent that the time for surrender of the

Patna High Court Cr.Misc. No.55545 of 2017 (2) dt.22-11-2017 2/2 petitioners in the court below is extended for further six weeks from the date of receipt/production of a copy of this order. If the petitioners surrender in the court below within aforesaid period, they will be released on same terms and conditions as mentioned in the order dated 21.03.2017 passed in Cr. Misc. 7879 of 2017. Let this order be communicated to the Court of Chief Judicial Magistrate, Araria, in connection with Jogbani (Bathnaha) P.S. Case No. 98 of 2016.
