JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-06-2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Jokihat P.S. Case No. 307 of 2017 registered for the offences punishable under Sections 144, 188, 283, 290, 447, 323, 353, 153(A) (B) 295(A), 307, 427, 504, 120B of the Indian Penal Code and 7 of Essential Commodities Act.
Petitioners are named in the first information report but no specific overt act has been attributed against the petitioners. Moreover, having, more or less, similar allegation, co-accused
Patna High Court Cr.Misc. No.31728 of 2018 (3) dt.22-06-2018 2/2 Shams Rabbani has already been admitted to anticipatory bail by a co-ordinate Bench of this Court vide order dated 01.02.2018 passed in Cr. Misc. No. 4415 of 2018 and, therefore, to maintain parity of justice, let the petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Araria in Jokihat P.S. Case No. 307 of 2017 subject to condition as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) N.K/- U T
