2. The petitioner has preferred this application for grant of regular bail in connection with Pirbahor P.S. Case No. 641 of 2023 dated 03.09.2023 registered for the offences punishable under Sections 147, 148, 149, 307 of the Indian Penal Code, Section 27 of Arms Act and Section 37 of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, the petitioner and the co-accused persons have alleged to have fired upon the informant due to which he sustained gun shot injury on his thigh.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.29286 of 2025(2) dt.06-05-2025 2/2 this case. Nothing has been recovered from the possession of the petitioner. There is general and omnibus allegation against the petitioner. There is no specific allegation against the petitioner. The petitioner has no concern with the alleged occurrence. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 21.03.2025. The co-accused person has already been granted regular bail by Coordinate Bench of this Court vide order dated 25.10.2024 passed in Cr. Misc. No. 36824 of 2024.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Patna in connection with Pirbahor P.S. Case No. 641 of 2023.

7. The application stands allowed.
