The petitioner apprehends her arrest in connection with Maheshkhunt P.S. Case No. 171 of 2017 registered under Sections 420, 409 and 468 of the Indian Penal Code. The accusation is of committing irregularity by Panchayat Rojgar Sevak in preparing the list of beneficiaries of candidates for providing the benefit of toilets in collusion with nine ward members including the petitioner.
Learned counsel for the petitioner submits that petitioner is one of the ward members and she has no concerned in preparing the list of beneficiaries. It is further submitted that similarly situated co-accused, Smt. Shanti Devi, who is also the
Patna High Court Cr.Misc. No.31428 of 2018(2) dt.13-06-2018 2/2 ward member, has already been granted privilege of pre-arrest bail by a Bench this Court vide order dated 08.05.2018 passed in Criminal Misc. No. 20802 of 2018.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate III, Khagaria, in connection with Maheshkhunt P.S. Case No. 171 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
