Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Shivsagar P.S. Case No. 49 of 2017 for the offence registered under sections 341, 323, 325, 307, 504 and 506/34 of the Indian Penal Code. At the outset, the learned counsel for the petitioner prays for withdrawal of the present petition with the liberty to approach the learned trial court for grant of regular bail on the ground that the specific allegation of grievous assault is on Vikash Kumar.

The permission is granted.

The petition is disposed off as withdrawn with liberty

Patna High Court Cr.Misc. No.52363 of 2017 (4) dt.23-01-2018 2/2 to the petitioner to approach the learned trial court for grant of regular bail and it is further directed that in case the petitioner surrenders before the court below, his application for regular bail shall be considered and disposed off on the same day considering the fact that the allegations of inflicting grievous injury is on Vikash Kumar and that the present case is an outcome of case and counter case.

The petition is disposed off.
