JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-06-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner seeks pre-arrest in connection with Rajoun P.S. Case No.34 of 2018 for the offences registered under Sections 341, 323, 307, 504/34 of I.P.C.

Allegation is that on 26.01.2018, the informant Bablu Rajak came out of his house to throw water, then his neighbour Mehandi Rajak, Mangan Rajak and Phool Chand Rajak started to abuse him, when he made protest, they assaulted him with Lathi Danda. In course of which, Mangan Rajak caused injury with lathi on his head and when the son Amrit Rajak and wife Rekha Devi of the informant came, then all the aforesaid persons also assaulted and in course of which, Mangan Rajak gave knife blow to his son

Patna High Court Cr.Misc. No.31959 of 2018 (2) dt.13-06-2018 2/2 causing injury in his waist.

Learned counsel appearing on behalf of the petitioner submits that, in fact, due to petty dispute, also petitioner's side sustained injury, regarding which, Photo Devi, mother of the petitioner also filed a case in the Court of Chief Judicial Magistrate, Banka. Moreover, informant and his wife sustained only one injury. Petitioner has got no criminal antecedent. Having considered the facts and circumstances of the case, let the petitioners, above named, in the event of arrest or surrender before the learned Court below within six weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in Rajoun P.S. Case No.34 of 2018 subject to the condition as laid down under Section 438(2) Cr.P.C.
