The present application has been filed for modification of the order dated 18.04.2018 passed in Cr.Misc.No.22248 of 2018, by which the petitioner was granted anticipatory bail in connection with Dalsingsarai P.S. case No.239 of 2017, pending in the court of Special Judge (Excise), Samastipur and the petitioner was directed to surrender and furnish bail bond in the court below within a period of six weeks.

It is submitted on behalf of the counsel for the petitioner that due to inadvertence, in the cause title of the order dated 18.04.2018 passed in Cr.Misc.No.22248 of 2018 the father's name of the petitioner has wrongly been typed as "Late Narayan Singh" in place of "Nageshwar Singh".

Let in the cause title of the order dated 18.04.2018 passed in

Patna High Court Cr.Misc. No.31905 of 2018(2) dt.21-06-2018 2/2 Cr.Misc.No.22248 of 2018, the father's name of the petitioner be read as "Nageshwar Singh" in place of "Late Narayan Singh". It is further submitted on behalf of the petitioner that due to aforesaid reasons the petitioner could not surrender in the court below.

It is further prayed on behalf of the counsel for the petitioner that further time may be extended so that the petitioner could surrender and furnish bail bond in the court below. Considering the submissions made on behalf of the learned counsel for the petitioner and the grounds mentioned in the modification application, the period of surrender of the petitioner in the court below is extended for a further period of six weeks from the date of receipt/production of a copy of this order. The rest of the conditions stipulated in the order well be same. The order dated 18.04.2018 passed in Cr.Misc.No.22248 of 2018, is modified to the extent as indicated above.
