JUSTICE SUDHIR SINGH ORAL ORDER 13-05-2019 Heard learned counsel for the petitioners, learned APP for the State and learned counsel for the informant. The petitioners seek bail in a case instituted for the offences under Sections 363 and 365 of the Indian Penal Code. The prosecution case in short is that the son of the informant left home for tuition along with another but did not return.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 12.1.2019 and have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. Charge-sheet has been

The son of the petitioner returned but the victim did not return. For the said reason, suspicion has been raised upon the son of the petitioner. Except suspicion, there is no substantive evidence to suggest the implication of the petitioner in the present case. No offence under section 365 IPC is made out.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Koilwar P.S. Case No. 463/18.
