Mr. Shailendra Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 08-04-2022 Heard learned counsel for the parties through virtual court proceedings.

The petitioners apprehend their arrest in Sonepur P.S. Case No.763 of 2020, registered for the offences punishable under Sections 341, 323, 504, 506, 325, 307 and 354(B) of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. It is submitted that the petitioners are said to have

Patna High Court CR. MISC. No.39381 of 2021(3) dt.08-04-2022 2/2 assaulted the informant and his son. It is further submitted that the injury report shows that the injuries are simple in nature. It is also submitted that the petitioners and informant are agnates and there is land dispute between the parties. It is lastly submitted that the petitioners have got no criminal antecedent as stated in paragraph 3 of the bail petition.

Learned APP for the State opposed the prayer for anticipatory bail of the petitioners.

Taking into consideration the facts that the injuries are simple in nature and there is land dispute between the parties, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be released on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Sonepur P.S. Case No.763 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure. (Anjani Kumar Sharan, J.) Sanjay/- U T
