JUSTICE ANIL KUMAR SINHA ORAL ORDER 20-08-2019 The petitioner apprehends his arrest in connection with Kotwali (Kasim Bazar) P. S. Case No. 296 of 1999 registered under Sections 323, 376, 379, 448/34 and 511 of the Indian Penal Code.
Allegation against the petitioner is that on the date of occurrence, petitioner along with co-accused persons entered into the house of the informant and tried to outrage her modesty on gun point. It has further been alleged that upon objection, petitioner and other accused persons assaulted the informant by pistol butt on chest and other parts of the body and petitioner along with other accused persons torn sari of the informant. Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case
Patna High Court CR. MISC. No.28500 of 2019(4) dt.20-08-2019 2/2 and police after investigation has not submitted charge sheet under Section 376/511 of the Indian Penal Code. It appears that case is of the year 1999 i.e., about 20 years back and petitioner was absconding since then. As the matter is very stale, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, it is rejected.
