JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-12-2021 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in Bhorey Police Station Case No. 263 of 2018/GR No. 3360 of 2018 registered for the offences punishable under section 302 and other allied sections of the IPC and section 27 of the Arms Act. As per the prosecution case, this petitioner caused fire arms injury to the Bhabhi of the informant as a result of which she died.

Learned counsel for the petitioner submits that there is land dispute between the parties due to both sides opened firing and in fact victim died in the firing made by the informant side. He further submits that the incident of firing took place on the spur of moment. Petitioner has got clean antecedent as stated in paragraph 3 of the bail petition. Petitioner is in custody since

Learned counsel for the State opposes the prayer for bail and submits that the petitioner is the assailant of the deceased.
