This is a petition for grant of anticipatory bail for offence under Sections 302, 201 and 34 of the Indian Penal Code. The informant was tenant in the house of petitioner. The dead body of her son was noticed by the side of a nala, then, the informant suspected that the petitioner and others have committed murder.
Submission of the petitioner is that the case diary would reveal that some other witnesses stated that for dispute regarding some bet as to which team would win the cricket match an occurrence of assault had taken place and deceased fell unconscious and he was thrown by the side of nala by other coaccused and in that statement also the name of the petitioner does not appear.
Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory
Patna High Court Cr.Misc. No.53078 of 2016 (3) dt.28-01-2017 2/2 bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Kotwali P.S. Case No. 148 of 2016 to the satisfaction of the Chief Judicial Magistrate, Patna, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
