The petitioner seeks bail in Angar Ghat P. S. Case No. 1 of 2019 instituted for the offence under Section(s) 302/34 of the Indian Penal Code.
Learned counsel for petitioner submits that mere suspicion has been raised against this petitioner. In the written report it is alleged that informant got information that his sister aged about 65 years who was living with her younger daughter- in- law, namely, Dharamshila Devi has been killed. The informant has raised suspicion against the younger daughter -in-law of his sister and this petitioner who might have committed the murder of his sister.
Patna High Court CR. MISC. No.27701 of 2019(4) dt.12-07-2019 2/2 It is mentioned in the impugned order that witnesses have stated that there was illicit relationship between the petitioner and daughter -in -law of the deceased. There is no eye witness to the occurrence.
Learned counsel for the informant has appeared and opposed the prayer for bail.
Petitioner is in custody since 4.1.2019.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-II, Dalsinghsarai, Dist. Samastipur, in connection with Angar Ghat P. S. Case No. 1 of 2019 subject to the condition that both the bailors shall be the close relative of petitioner.
