ANJANA MISHRA ORAL ORDER 07-09-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner, who is a PDS Dealer, is apprehending his arrest in connection with Maniyari P.S. Case No. 43 of 2016 registered for the offences punishable under Section 7 of the Essential Commodities Act.
Learned Senior Counsel for the petitioner submits that the petitioner being the licensed PDS Dealer had been conducting his business with most integrity but the informant lodged a complaint against the petitioner in the present malicious prosecution. He, however, submits that whatever be the nature of allegations his license has already been cancelled and he is to face malicious prosecution under the relevant licensing policy.

No.28775 of 2016 (4) dt.07-09-2016 2/2 In view of the aforementioned facts and circumstances of the case that the petitioner has clean past, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, (West) Muzaffarpur in connection with Maniyari P.S. Case No. 43 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
