KUMAR ORAL ORDER 24-05-2018 Heard learned counsel for the petitioner and the State. Petitioner seeks pre-arrest bail in Bettiah Muffasil P.S. Case No.128 of 2017 instituted for the offences under Sections 147, 148, 149, 449, 448,353,153(A), 188, 295, 504 and 506 of the I.P.C.
As per the written report, acting upon a tip of the information that on account of construction work in the village near small canal, the situation between both community had become tense, the informant reached there along with police party and found that members of both the families were adamant to riot. They also caused obstruction in discharging official duty of the informant.
Learned counsel for the petitioner submits that the name
Patna High Court Cr.Misc. No.31695 of 2018 (2) dt.24-05-2018 2/2 of the petitioner has been disclosed by the chowkidar and spy. There is general and omnibus allegation against the petitioner. It is further submitted that similarly situated co-accused persons have already been granted anticipatory bail by different coordinate Bench of this Court vide orders as contained in Annexure-2 series to this petition.
Considering the facts and circumstances of the case, le the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M.-Bettiah, West Champaran, in Bettiah Muffasil P.S. Case No.128 of 2017 subject to the conditions as laid down under Section 438(2) of Cr.P.C. (S. Kumar, J) AnilKrSinha/- U
