The petitioner is in custody in connection with Raushanganj (Bankey Bazar) P.S. Case No. 13 of 2019 for the offences under Sections 341, 323, 379, 504/34 of the Indian Penal Code and Section 37(b)(c) of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 03.04.2019. He further submits that allegation against this petitioner is that three persons in drunken condition assaulted the informant and took away of Rs.3000/- and he submits that similarly circumstanced co-accused have been granted bail by co-ordinate Bench of this Court.

Considering the fact that petitioner has no criminal

No.29247 of 2019(2) dt.02-05-2019 2/2 antecedent and similarly circumstanced co-accused have been granted bail by co-ordinate Bench of this Court, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Special Judge, Excise, Gaya in connection with Raushanganj (Bankey Bazar) P.S. Case No. 13 of 2019.
