2. The petitioner seeks bail in a case registered for offence under Sections 302, 201, 120(B) of the Indian Penal Code.
3. As per prosecution case, the grand son of the informant went to the house of his Fufi and when did not return till 7.00 P.M., the daughter-in-law of the informant inquired about her missing son, but did not find him and subsequently, the dead body of the grand son of the informant was found lying in the maize field of the informant. It is alleged that one month before, the informant's niece has been murdered by co-accused Kaila @ Hasim and his other relatives and hence, he suspects that all the F.I.R. named accused persons including this petitioner committed the murder of grand son of the informant.

4. Learned counsel for the petitioner submits that informant is not eye-witness of the occurrence and only on suspicion, petitioner and others have been made accused in this case. He further submits that co-accused Aalam, who is brother of petitioner, has already been granted bail by a coordinate Bench of this Court, vide order dated 25.04.2023 passed in Cr.Misc. No. 69165 of 2022 (Annexure - 2). He next submits that police, after investigation, has already submitted chargesheet. Petitioner has got clean antecedent and is in custody since 23.01.2023.
5. Learned A.P.P. for the State vehemently opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. District & Session Judge, Araria in connection with Sessions Case No. 128 of 2024, arising out of Sikti P.S. Case No. 118 of 2022. (Prabhat Kumar Singh, J) anay U T
