The petitioners seek pre-arrest bail in connection with Bettiah Town (Kalibag O.P.) P.S.Case No. 540 of 2017 registered under Sections 147, 149, 341, 323, 324, 354, 379 and 504 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioners that there is no allegation that the petitioners outraged the modesty of any lady member of the family of the informant. He submitted that there is case and counter case and both parties sustained simple injuries.

Learned counsel for the State opposed the application

Patna High Court Cr.Misc. No.54941 of 2017 (2) dt.19-12-2017 2/2 for grant of pre-arrest bail to the petitioner. Taking into consideration the nature of allegation made in the FIR and in view of the submission made above, in the event of arrest or surrender before the court below within four weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah Town (Kalibag O.P.) P.S.Case No. 540 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
