JUSTICE RAKESH KUMAR ORAL ORDER 04-07-2016 Heard Sri Pankaj Kumar Sinha, learned counsel, who was assisted by Sri Diwakar Sinha, learned counsel for the petitioners and Sri Anil Kumar Singh no.1, learned Addl. Public Prosecutor.

Two petitioners, apprehending their arrest in Kurlikot P.S. Case no.09/2016 registered for the offence under Sections 353, 323/34 of the Indian Penal Code, have prayed for grant of anticipatory bail.

It was submitted by learned counsel for the petitioners that the petitioners were falsely implicated in the present case. He further submits that the petitioners are driver and Khalasi of the vehicle.

Patna High Court Cr.Misc. No.26568 of 2016 (2) dt.04-07-2016 2/2 Learned Addl. Public Prosecutor has opposed the prayer for anticipatory bail.

Besides hearing learned counsel for the parties, I have also perused the material available on record including the F.I.R. In the F.I.R. there is specific accusation against the petitioners that they interfered with the official duty of the informant.

In view of facts and circumstances, I do not find any ground to extend the privilege of anticipatory bail. The petition stands dismissed.
