The petitioner has preferred this application for grant of regular bail in a case registered under section 302 of the Indian Penal Code.
As per the prosecution case, the son of the informant was shot from behind as a result of which he died. It is submitted by learned counsel for the petitioner that the F.I.R. was registered against unknown. The name of the petitioner transpired on the basis of alleged confessional statement of the petitioner himself in connection with Ahiyapur P.S. Case no.1369 of 2019 made before police. Even as per the said statement, it was co-accused who is the assailant of the deceased. The petitioner is in custody since 22.2.2021 and

Having heard learned counsel for the parties and taking into consideration the facts of the case, the material that has transpired in course of investigation together with the petitioner having remained in custody for more than 11 months, the Court directs the petitioner to be enlarged on bail in connection with Motipur P.S. Case no.59 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, West, Muzaffarpur.
