2. The petitioner apprehends his arrest in a case registered for the offence under Sections 307, 147, 148, 341, 323, 379, 504, 506 and 324 of the Indian Penal Code.
3. As per the prosecution case, dispute between the parties arose while playing cricket and thereafter eight named accused persons including this petitioner assaulted the informant by means of lathi and knife. It is further alleged that co-accused Mantu Yadav stole the laptop and mobile phone of the informant.
4. Learned counsel for the petitioner submits that the allegation of assault is general and omnibus. Injuries allegedly caused by the petitioner is simple in nature. Similarly situated
Patna High Court CR. MISC. No.31518 of 2024(2) dt.12-07-2024 2/2 co-accused have been granted bail vide order dated 27.02.2024 passed in Cr. Misc. No. 67156 of 2023. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within a period of six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Gaya in connection with in connection with Gaya Mufassl P.S. Case No. 226 of 2023 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
