2. The petitioner has filed the instant application for the following relief (s) :- "1. I. For a issuance appropriate writs/orders/directions for quashing the order of C.D.P.O., Sanhaula, Bhagalpur 15.04.2023 as contained in Memo No.-124 and through which, the petitioner has been terminated mechanically from her post as Aanganvari Sevika at Centre No.- 30 Panchayat-Dhoabai, Ward No.-11 under Block-

II. For direction to the respondents to reinstate the petitioner to her post as Aanganvari Sevika at Centre No.-30, Panchayat-Dhoabai, Ward No.-11, under Block-Sanhaula, Bhagalpur Consequent of the quashing of the order of CDPO, Sanhaula, Bhagalpur dated 15.04.2023 bearing Memo No. 124 and accordingly to issued direction to the respondent authorities to pay all consequential benefits for which the petitioner is entitled from the date of her illegal termination. III. For any other relief/reliefs as your lordships may deem fit and proper in the backdrop of existing facts and circumstances of the case."

At the outset, learned counsel for the respondents raises a preliminary objection that against the order of termination impugned herein, the same having been passed by the Child Development Project Officer, Sanhaula, Bhagalpur (respondent no.6), the petitioner has an alternate and efficacious remedy of preferring an appeal/ moving an application before the District Programme Officer (ICDS), Bhagalpur (respondent no.5).

4. Having heard learned counsel for the parties, the writ application is disposed of directing the petitioner to file an appropriate application/appeal before the District Programme Officer (ICDS), Bhagalpur (respondent no.5) within a period of

5. On filing of the same, the respondent concerned shall decide the representation/appeal of the petitioner in accordance with law at the earliest preferably within a period of three months from the date of its filing.
