JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-06-2018 The petitioner seeks bail in anticipation of his arrest in connection with Belaganj P.S. Case No. 71 of 2017 dated 16.03.2017 instituted for the offences under Sections 406, 409, 420, 120B of the Indian Penal Code.

For obtaining appointment in the Government Department, a huge amount of money was given by the informant to one Ram Vidyut Kumar Singh who is brother-inlaw of the petitioner. When the appointment could not be given, aforesaid Ram Vidyut Kumar Singh tried to return the amount by two cheques but the same got bounced. The learned counsel for the petitioner has submitted that but for a vague statement that the petitioner also helped

Patna High Court Cr.Misc. No.32904 of 2018 (2) dt.29-06-2018 2/2 Ram Vidyut Kumar Singh in extracting money from the informant, he has been made accused in this case. No amount of money has been transferred in favour of the petitioner. The petitioner has no concern with the affairs of aforesaid Ram Vidyut Kumar Singh.

Considering the aforestated facts, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, XI, Gaya in connection with Belaganj P.S. Case No. 71 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Ashutosh Kumar, J) Shageer/- U T
