This is an application for grant of anticipatory bail in connection with Muffasil P.S. Case No. 82 of 2017 registered for the offence punishable under Sections 341, 323, 307, 385, 379, 354, 506, 504 and 34 of the Indian Penal Code. The allegation against the petitioners is regarding assaulting the informant resulting in simple and grievous injuries being suffered by him.
The learned counsel for the petitioners submits that the present case arises out of a case and counter case while the petitioners' side had instituted Muffasil P.S. Case No. 84 of 2017 (District-Nawada), the present case arises of Muffasil P.S. Case
Patna High Court Cr.Misc. No.62697 of 2017 (2) dt.11-01-2018 2/2 No. 82 of 2017. It is submitted that the petitioners' side have also received grievous injuries. It is further submitted that the petitioners have clean antecedent.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners above named, in the even of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M, Nawada in connection with Muffasil P.S. Case No. 82 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
It is further directed that the petitioners will present on each and every date before the learned trial court on the date fixed and in case of two consecutive defaults, the present privilege of anticipatory bail would be withdrawn and the petitioners would be taken into custody forthwith.
