The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 302, 120(B)/34 of the Indian Penal Code.

Prosecution case, in brief, is that informant has been residing at his sasural since 15 years. It is alleged that Sahmeena Begum who is the cousin sister-in-law of the informant was working at the house of accused Alilur Rahman. In the meantime, the illicit relation was made between the Alilur

Thereafter, accused Alilur Rahman promised to solemnize marriage with her but the family members of the accused Alilur Rahman always used to deny the said marriage and threatened to kill her. It is alleged that on 04.02.2019 under criminal conspiracy the accused persons committed murder to victim Sahmeena Begum.

Learned counsel for the petitioner submits that he is innocent, bears no criminal antecedent and has been falsely implicated in the aforesaid case. He submits that there is specific allegation against accused Kaisar Alam and not against the petitioner.

In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Kishanganj in connection with Garbandanga Police Station Case No. 09 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case,

Patna High Court CR. MISC. No.28299 of 2019(3) dt.22-07-2019 3/3 failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
