JUSTICE PRABHAT KUMAR JHA ORAL ORDER 28-09-2020 Heard learned counsel for the petitioner and Mr. Anand Mohan Mehta, learned Additional P.P. through video conferencing. The petitioner seeks bail in Pusa P.S. Case No.94 of 2019, registered under Sections 30(a) and 41(2) of the Bihar Prohibition and Excise Act.
The informant after having received secret information raided the house of Manoj Rai and Monu Kumar. From the house of the petitioner Manoj Rai, 50 bottles each containing 750 ml. of Casinos Pride Whiskey, 27 bottles each containing 375 ml. of Blue Blezer Whiskey and 65 bottles each containing 180 ml. of Blue Blezer Whiskey and 12 bottles each containing 375 ml. of Imperial Blue Whiskey were recovered.
It appears that about 65 litres of Indian made foreign liquor was recovered from the house of the petitioner and for that
Patna High Court CR. MISC. No.25225 of 2020(2) dt.28-09-2020 2/2 the petitioner is in jail since 24.06.2020. The petitioner has already remained in jail fore more than three months for recovery of about 65 litres of foreign liquor.
Taking into consideration the facts aforesaid, petitioner, namely, Manoj Roy @ Manoj Rai @ Manoj Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, 2nd - cumSpecial Judge, Excise, Samastipur in connection with Pusa P.S. Case No.94 of 2019.
