02-11-2015 Heard learned counsel for the petitioner and Sri Dinbandhu Singh, learned Govt. Pleader - 9.

In the present writ petition, in sum and substance, the petitioner has made a prayer for executing the order passed by the House Controller-cum-SDO.

In this case, a counter affidavit has been filed on behalf of respondent/State, wherein, a stand has been taken that prior to filing of the writ petition, the petitioner filed an execution case before the Sub-Judge 1st, Patna, vide Execution Case No. 32

Patna High Court CWJC No.2690 of 2015 (7) dt.02-11-2015 2/2 of 2011, which is pending.

In view of the fact that the execution case is already pending, there is no need to pass any positive order in the writ petition.

The writ petition stands disposed of.

Since both the parties have appeared before this Court, while disposing of the writ petition, it is necessary to observe that respondents must render full cooperation to the executing court for early disposal of the same. At the same time, it is further observed that learned Sub-Judge 1st, Patna may take step so that order of the House Controller-cum-SDO be implemented without any delay in accordance with law.
