The petitioners apprehend their arrest in Inarwa P.S. Case No. 69 of 2017 instituted for the offence under Sections 341, 323, 324, 307, 427/34 of the Indian Penal Code and Section 27 of the Arms Act.

This is second anticipatory bail application filed on behalf of the petitioner. The earlier anticipatory bail application filed on behalf of the petitioner after some argument, was dismissed as withdrawn by this Court vide order dated 17.10.2017 passed in Cr. Misc. No. 49932 of 2017.

Learned counsel for the petitioner has submitted that injury found on the person of the injured does not support the

Patna High Court Cr.Misc. No.60786 of 2017 (2) dt.10-01-2018 2/2 allegation against this petitioner.

In the written report there is specific allegation against this petitioner of causing firearm injury on the chest of the informant with gun and also causing injury in the right hand. The injury report has been enclosed as Annexure-3 wherein the Doctor has found firearm injury on the chest of the informant as well as on the right arm but opinion has been kept reserved.

Therefore, this Court does not find fresh ground for grant of anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner in connection with Inarwa P.S. Case No. 69 of 2017, G.R. No. 3138 of 2017 pending before Sri Manash Kumar, learned Judicial Magistrate, 1st Class, Narkatiaganj, Distt.West Champaran, stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail which shall be disposed off by the court below in accordance with law without being prejudiced by this order.
