2. The petitioner is apprehending his arrest in connection with Biharsharif P.S. Case No. 770 of 2024 registered for the offence punishable under Sections 137(2) and 70(2) of the Bharatiya Nyaya Sanhita and section 4&6 of the POCSO Act as also section 3(1)(r),(s),(w)(i) and 3(2)(v) of the SC/ST Act, lodged on 15.10.2024 by the informant Jhulan Kumari.
3. As per the prosecution story, the informant alleged that while she was out to attend the fair, Kaushal Kumar Yadav
Patna High Court CR. MISC. No.29709 of 2025(3) dt.03-09-2025 2/3 with pistol in hand forced her to sit on the motorcycle, he was supported by Situ Kumar and Ranjan Yadav. She was later subjected to Gang Rape which followed the F.I.R.
4. Learned counsel for the petitioner submits that exaggerated F.I.R. is there, no medical examination took place, only to implicate the petitioner, as a counter blast to Kalyanbigha P.S. Case No. 65 of 2024, the present theory has developed.
5. Actually, the girl was having relationship with Kaushal Kumar Yadav and only to teach lesson to him, the present case in which the petitioner also founds implicated.
6. In this case, the coordinate Bench had called for the case diary which is now on record.

Learned APP Mr. Bharat Bhushan as also learned counsel representing the informant has taken this Court to paragraph no.200 of the case diary to show that contrary to the statement made in paragraph no.3 that the petitioner do not have criminal antecedent, actually, he is an accused in Salimpur P.S. Case No. 168 of 2023 lodged on 25.07.2023 under section 147, 148, 149, 307, 504 and 506 of the Indian Penal Code beside section 27 of the Arms Act.
8. They further took this Court to paragraph no. 202
Patna High Court CR. MISC. No.29709 of 2025(3) dt.03-09-2025 3/3 to show that pursuant to the processes issued amongst other the petitioner herein, the Police had already completed the formalities.
9. Considering the submission of the parties as also the fact that the petitioner chose to suppress the criminal antecedent by recording in paragraph no.3 of the petition that he do not have any criminal antecedent, the process already stand issued/complied, it would be appropriate that the petitioner seek bail.
10. Accordingly, the anticipatory bail application stands rejected.
