JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 13-12-2017 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek pre-arrest bail in connection with Sadar (Mabbi O.P.) P.S. Case No. 517 of 2015 registered under Sections 341, 323, 307 and 504 read with 34 of the Indian Penal Code.
Regard being had to the direct and specific allegation made in the FIR against petitioner no.1, Dheraba
Patna High Court Cr.Misc. No.59392 of 2017 (2) dt.13-12-2017 Karori @ Karori @ Gupta Karori that he assaulted with bottle of wine on the head of the informant as a result of which, he sustained serious injuries, I am not inclined to grant him pre-arrest bail. Accordingly, his application for grant of pre-arrest bail is rejected.
So far as the other three petitioners, namely Rajiv Karori @ Rjua, Buchna Karori and Moti Karori are concerned, there is an omnibus and general allegation against them that they also created ruckus at the place of occurrence, in the event of arrest or surrender in the court below within six weeks from today, the petitioners, who are said to be men of clean antecedent are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Sadar (Mabbi O.P.) P.S. Case No. 517 of 2015 subject to the conditions as laid down under Section 438(2) Cr. P.C.
