From the pleadings it appears that all post retiral benefits of the petitioner have been paid. However, learned counsel for the petitioner submits that 3rd ACP and two increments is still due
Patna High Court CWJC No.14952 of 2013 dt.26-08-2016 2/2 and rate of interest of GPF have not been correctly paid. Having regard to the fact that the writ petition was for retiral benefits and the same have been paid, nothing remains and accordingly, the application stands disposed off. However, as far as there being some discrepancy with regard to the rate of interest of GPF as claimed by the petitioner, he is at liberty to file a representation within four weeks from today along with a copy of this order before the respondent no. 10, who shall consider the grievance and pass a reasoned order within four weeks thereafter. If some additional payment is required to be made to the petitioner, the same shall also be paid within the next three weeks. As far as the claim for grant of 3rd ACP and two increments are concerned, the same being a separate cause of action, it shall be open to the petitioner to claim the relief before an appropriate forum in accordance with law.
