JUSTICE VIKASH JAIN ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 12-02-2015 This suo motu contempt is taken up on the basis of the report submitted by the learned District & Sessions Judge, Bhojpur, at Ara on 8.2.2015 as well as certain newspaper clippings. The issue pertains to the frisking of the Judicial Officers at the premises of the district court, Ara.

We issued notice to the learned Advocate General and passed an order on 9.2.2015. In compliance with the same, the Superintendent of Police, Bhojpur appeared before us. The detailed explanation as well as annexures are filed; and the learned Advocate General advanced detailed argument.

It is a serious matter that the Judicial Officers were subjected to frisking. In the counter affidavit it is stated that the

Patna High Court OCR. MISC (DB) No.2 of 2015 (3) dt.12-02-2015 2/2 concerned A.S.I. who was on duty on 7.2.2015 acted in irresponsible manner and contrary to the specific instructions. It is also brought on notice that disciplinary proceedings were initiated not only against that A.S.I. but also other police personnel who were accompanying the criminal who escaped from the premises, on 23.1.2015.

In that view of the matter, we close this contempt case. We also make it clear that none of the observations shall be treated as reflection on the service of the erring police personnel. (L. Narasimha Reddy,CJ) (Vikash Jain, J) mrl U
