2. The petitioners seek bail in in connection with Mufassil P.S. Case No. 52 of 2024 instituted for the offences under Section 392 of the Indian Penal Code in which Section 411 of the Indian Penal Code was added subsequently.
3. Prosecution allegation, in short, is that when the informant reached near Fakuli Netwa Baba, he saw that two persons with their bike came in front of the informant and stopped him on the point of dagger, took all the articles from his possession and fled away with articles.
4. Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.32246 of 2024(2) dt.29-04-2024 2/2 petitioners are innocent and have falsely been implicated in the present case. The petitioners have got no concern with the alleged occurrence. No incriminating material has been recovered from the conscious possession of the petitioners. The petitioners have not been put on Test Identification Parade to ascertain his participation in the alleged occurrence. The petitioners are in custody since 03.02.2024.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners.
6. Considering the aforesaid facts and circumstances of the case and the period of custody undergone by the petitioners, this Court is inclined to grant bail to the petitioners.
7. Let the petitioners be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Mufassil P.S. Case No. 52 of 2024.
