The petitioner apprehends his arrest in connection with Complaint Case no. 1021(c)/16 registered under Sections 406 and 420 of the Indian Penal Code.

The complainant alleged against the petitioner that he had advanced Rs. 6,6000/- to nine persons including the petitioner for working in a brick kiln but he and others did not work for the advance taken by the complainant.

Learned counsel for the petitioner submits that no advance was taken by the petitioner. Similarly situated co-accused persons, namely, Hira Chauhan and Shiv Kumar Chauhan have

Patna High Court Cr.Misc. No.108 of 2018 (2) dt.12-01-2018 2/2 been granted anticipatory bail vide order passed in Criminal Miscellaneous No. 57874 of 17 and in Criminal Miscellaneous No. 58022 of 2017 respectively. The case of the petitioner stands on the same footing.

Considering the facts and circumstances, let the petitioner, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each in connection with Complaint Case No. 1021(c) of 2016 to the satisfaction of the learned Judicial Magistrate, Patna City or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
