JUSTICE SANDEEP KUMAR ORAL ORDER 21-06-2024 This is the second attempt of the petitioner for grant of regular bail as earlier the bail application of the petitioner was rejected vide order dated 11.10.2023 passed in Cr. Misc. No. 64304 of 2023.

2. Heard learned counsel for the petitioner and learned APP for the State.

3. The petitioner seeks bail in connection with S.T. No. 358 of 2023 arising out of Rajoun (Nawada O.P.) P.S. Case No. 17 of 2023 registered for the offence under Sections 304B of the Indian Penal Code.

4. As per the prosecution case, the petitioner is accused of killing his wife.

5. The petitioner is in jail since 13.1.2023.

6. It has been submitted by the learned counsel for the petitioner that though, the charge has been framed on 2.6.2023 but till date only one witness, that too a doctor has been examined.

7. It appears that the prosecution is not interested

Patna High Court CR. MISC. No.34066 of 2024(2) dt.21-06-2024 2/2 in conclusion of the trial of the petitioner. Earlier, this Court while considering the bail application of the petitioner has noted that the deceased may have committed suicide.

8. Considering the delay in the trial and noncooperation of the prosecution side in the trial, this application is allowed.

9. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I, Banka in connection with S.T. No. 358 of 2023 arising out of Rajoun (Nawada) P.S. Case No. 17 of 2023.

10. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
