The petitioners seeks bail in anticipation of his arrest in connection with Teghra P.S. Case No. 65 of 2020 dated 11.03.2020 instituted for the offence under Sections 30(a) of Bihar Prohibition Excise Act. It has been submitted on behalf of the petitioner that 10.380 litres of liquor is stated to have been recovered from in front of the house of the petitioner.

However, considering the fact that the petitioner was earlier made accused in a similar nature of case in which he was granted anticipatory bail, I am not inclined to exercise my discretion of granting

Patna High Court CR. MISC. No.25736 of 2020(3) dt.20-10-2020 2/2 anticipatory bail to the petitioner for the second time in this case.

The petition is dismissed.

If the petitioner surrenders before the court below and seeks bail, his petition shall be considered on its own merits without being prejudiced by the fact that the present petition has not been entertained. (Ashutosh Kumar, J) krishna/- U T
