JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Chandauti Police Station Case No. 92 of 2016 registered for the offences punishable under Section 414 of the Indian Penal Code. Two pick-up-vans laden with coal were seized by the informant who lodged the present case on the basis of suspicion that the seized coal might be stolen property. Submission on behalf of the petitioner is that petitioner happens to be owner of the seized vehicles and coal. It is further submitted that except suspicion, there is nothing against the petitioner.

Considering the aforesaid facts and circumstances as

No.30611 of 2016 (4) dt.10-01-2017 2/2 well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in Chandauti Police Station Case no. 792 of 2016, subject to condition as laid down under Section 438(2) of the Cr.P.C.
