The petitioners apprehend their arrest in Complaint Case No.4287©/2015 registered under Sections 323, 406 and 420 of the Indian Penal Code.

The complainant is own sister of petitioner no.2. The petitioner no.1 is husband of petitioner no.2 and petitioner no. 3 and 4 are son and daughter of petitioner no.1 and 2. The complainant made allegation that he lent money to his sister and

Patna High Court Cr.Misc. No.34379 of 2018 (2) dt.29-06-2018 2/2 brother-in-law for the marriage of their daughter and Rs. 2, 31, 000/- was lying with them as arrear of rent. Altogether 4, 19, 000/- was lying due against the petitioners. When the complainant demanded money, the accused persons assaulted and snatched her ornaments.

Learned counsel for the petitioners submits that there is no chit of paper to show that the petitioners ever borrowed any money from the complainant. The complainant is own sister of petitioner no.2 and on account of some land dispute and with regard to share in land, the complainant filed this case. Considering the aforesaid fact, the petitioners above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Smt. Ritu Kumari, J.M.1st Class, Patna, in connection with Complaint Case No.4287©/2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
