The sole petitioner, apprehending his arrest in Bodh Gaya P.S. Case no.285/2015 registered for the offence under Sections 420,406, 323, 504 and 34 of the Indian Penal Code, has prayed for grant of anticipatory bail.
Learned counsel for the petitioner, by way of referring to F.I.R., submits that on perusal of the F.I.R., it is evident that the allegation primarily pertains to dispute in partnership business. However, only with a view to put undue pressure, a colour of criminal offence has been given in the present case.
Besides hearing learned counsel for the parties, I have also perused the materials available on record. After
Patna High Court Cr.Misc. No.26481 of 2016 (2) dt.30-06-2016 2/2 examining the material, the Court is satisfied that it is a fit case for extending the privilege of anticipatory bail. Let the petitioner, namely, Pankaj Kumar Verma, in the event of his arrest or surrender within six weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Bodh Gaya P.S. Case no.285/15 , subject to condition as laid down in Section 438(2) of the Code of Criminal Procedure.
