The petitioner apprehends his arrest in connection with Katihar Town P.S. Case No.558 of 2017 registered under Sections 25(1-B)A, 26 and 35 of the Arms Act.
The accusation is that on seeing the informant, the Officer Incharge of Katihar Town Police Station, and the other police officials, two persons started to flee away with scooty but, on chase, one was apprehended, who disclosed his name as Md. Sahazada Ansari. On search, he was found in possession of one loaded country made pistol and he also disclosed the name of the petitioner, who succeeded in fleeing away.
Patna High Court Cr.Misc. No.55137 of 2017 (2) dt.24-11-2017 2/2 Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the name of the petitioner has been disclosed by the co-accused Md. Sahazada Ansari, who was apprehended on the spot. The petitioner has no criminal antecedent.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar, in connection with Katihar Town P.S. Case No.558 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
