In this case, the petitioner is seeking anticipatory bail in connection with Mufassil P.S. Case No. 334 of 2018 registered for offence punishable under sections 121, 379, 414, 120(B) /34 of the Indian Penal Code, section 25(1-a)/25(1aa)/25(1-b)a/26/35 of the Arms Act and section 39 of U.A.P. Act.
The petitioner is said to be involved in the racket of arms which was to be smuggled from Jabalpur factory through Ex-army man. The entire family member was involved as per FIR in keeping the arms at the safe place. The huge quantity of AK-47 has been recovered which was kept in a safe place under a pit and one Amna Khatoon has disclosed the name of
Patna High Court CR. MISC. No.29616 of 2019(2) dt.06-05-2019 2/2 this petitioner and her husband.
Looking to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner and accordingly her prayer for bail is rejected. However, if the petitioner surrenders and prays for regular bail, the court below after taking into consideration the entire facts and circumstances, will take decision in accordance with law without being prejudiced by this order.
