This application, for grant of regular bail, arises out of Chandramandih Police Station Case No. 69 of 2018, disclosing offences under Section 302/34 of the IPC and Section 3/4/5 of Explosive Substances Act.
As per the First Information Report prosecution case is that when the elder brother of the informant was sleeping in his house, he heard sound of explosion then he came and saw that this petitioner alongwith other FIR named accused persons fleeing away from the place of occurrence and found that his brother was dead. It is further alleged that on earlier occasion, accused persons threatened him with dire consequences. It is submitted on behalf of the petitioner that as per
Patna High Court CR. MISC. No.38793 of 2021(2) dt.13-12-2021 2/2 F.I.R., this petitioner is seen while fleeing away from the place of occurrence and nobody has seen him exploading the bomb. There is no eye witness of this occurrence and the allegation is levelled only on the basis of suspicion. Learned counsel further submits that petitioner is in custody since 14.01.2021 and similarly situated accused person has been granted bail by a Coordinate Bench of this Court vide order dated 13.11.2019 passed in Cr. Misc. No.64768 of 2019.
Having regard to the submissions made by the parties and taking into consideration the materials on record and the fact that petitioner is in custody since 14.01.2021 and similarly situated accused person has been granted bail, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Jamui, in connection with Chandramandih Police Station Case No. 69 of 2018.
